You do not need everything on this list to call. Whatever you have makes the first conversation more useful.
Anything with a court date on it. A citation, a notice to appear, bail or release paperwork, or a notice of hearing. The date, the courthouse and the case number shape everything else.
Every document you were served with. For a restraining order, that means the petition, the temporary order, any attachments and the notice of hearing, read all the way through rather than just the first page.
A police report, if you received one, and the names of the agency and officers involved.
Messages, photographs and video. Keep the complete conversations, not selected screenshots, and do not delete or edit anything. Download doorbell or security camera footage before it expires.
Names of people who saw or heard what happened, and how to reach them.
A short written timeline, made while the events are fresh: dates, times, places, and who was present.
If you do not have documents yet, call anyway. Waiting for paperwork is one of the ways the early part of a case gets lost.
What Happens on the First Call
The most useful first call covers where your case stands and what is coming next.
Be ready to explain the stage you are at: whether you were arrested, cited, charged, or served, which court the case is in, and the next date on the calendar. If a restraining order, a criminal case and a custody matter are running at the same time, say so, because each one affects the others.
Describe the situation in general terms. Contacting Jacob Levin Law, by telephone or through this website, does not create an attorney-client relationship. Please do not send confidential information through this site or by email until an attorney-client relationship has been established in writing.
[CLIENT CONFIRM: Consultation format and fee, including whether consultations are by phone, video or in person, how they are booked, and whether there is a charge. See confirmation set, item A5.]If You Were Just Arrested, or Just Served With a Restraining Order
Both situations move quickly, and a few early decisions are hard to undo.
Just arrested, or someone you love was. An arrest is not a conviction, and it is not yet a charge. You have the right to remain silent and the right to an attorney; use them, and do not try to explain your side to investigators first. Evidence such as surveillance video and phone records can disappear within weeks. Read criminal defense for how a case moves, and what to do first after an arrest.
Just served with a restraining order. Read every page of what you were served, because the order states its own terms and deadlines. Do not contact the protected person, even to explain or apologize, and even if they contact you. Preserve your messages and records, and do not skip the hearing. Start with responding to a domestic violence restraining order and served with a restraining order: start here.
Then call (530) 248-2700.
